That is fine while you have the rule of law and independent institutions to enforce those rights. When those institutions are eroded or facing the barrel of a gun then people's rights might as well he written on toilet paper.
You can't make up for a dysfunctional political system with demands for fictional rights.
People from one particular notable country always get the emphasis wrong in my opinion. Perhaps they are all brainwashed. They think the rights uphold their system when in truth it is the system that upholds the rights. It has kept them blind to the reforms needed to breathe life into a system that barely qualifies as a democracy by modern standards.
I'd also like to take this moment to remind how to handle a police interaction in the USA, in a one minute video described by a few lawyers: STFU Friday!
I grew up in a small town on the border when the border patrol would ask us if we had seen any aliens we would always just look up and say I think I saw one flying around up there
For at least the time being, we have the right to remain silent through the 5th amendment. Providing false information can incriminate you. Providing no information at all cannot (exceptions may be providing personal identification, licenses and registrations, look up your local laws). Know your rights and exercise them.
Disclaimer: I am not a lawyer and this is not legal advice
If you stonewall during an actual questioning with local police they can treat you as a hostile witness, or even attempt to charge you with aiding and abetting or impeding an investigation. It probably won't stick, but you're still not going to have a great time. As they say, you can beat the charge, but you can't beat the ride.
If you are officially being questioned be polite, keep an even tone and demeanor and state " I would really love to help you in your investigation, but I would like to speak to my lawyer first." If they press you afterwards just keep repeating that you would really like to help, but to do so you require legal representation. That way if anyone can be accused of slowing down an investigation it's the police, and it's because they are wasting time denying you your rights.
Do not make statements to the police without a lawyer present, even if it's something as small as "I don't know". More than likely if it's for immigration, these will be federal officers. If you lie to a federal officer, you will be charged with a felony.
So when they say “ok, call your lawyer” then what?
I don’t have a criminal defense attorney’s number memorized, nor have I ever engaged one. Do I just web search and pick the one in my area? Are they going to show up?
I hate that I've already posted the video twice so I'm not going to do it again because I don't want to get marked for spam lol, but check my comment history if you got a minute to see a few lawyers describe what to do.
In essence though, if it's a door knock don't even answer it. There's nothing good on the other side of that door, and in that scenario there are only two options for them: either they can get a warrant, in which case they're coming in anyway with or without your consent so it doesn't even matter, or if they don't have one (far more likely) then they can go pound sand for all I care. If I'm not legally obligated to answer that door then I'm not going to.
If it's a traffic stop, it's a simple amount of phrasing but amounts that are very important to say to exercise your rights. If being asked questions unrelated to the quoted traffic violation, a simple "I'm not discussing my day". If they continue asking questions, ask "Am I being detained or am I free to go". This forces them to either only engage in the stop as needed or, if they do detain, at this point the mystery is now gone and they have to handle things by the book: meaning you are informed that you are being detained, it is for xyz reason of belief, then at this point you can state that you "invoke the fifth" (must be said, but you have the right to not answer questions and not self-incriminate), and then you STFU. If said detainment was ever escalated from there to the point of being thrown in the back of the squad car, it's at this point that you could then request an attorney at the station and IIRC they must provide one. It will likely be an overworked public defendant attorney, but to answer the question there you go.
TLDR Don't be the soverign citizen immediately starting with "I want a lawyer am I detained am I free to go" as soon as they walk up to the window, but know your rights and when to execute them in order. These rights apply to all people in America by the way, not just citizens, so keep that in mind and don't let feds try to scare you into thinking you don't have these kinds of rights. You do.
(I am not a lawyer, and this is not legal advice from a lawyer, just a local dumbass on the internet, but this is to my knowledge factual information.)
I think usually people just call a friend or family member and ask them to find one.
Or contact ACLU (for USA) and ask them to help you find one.
Or if your income is low, demand a public defender, you can always get a different lawyer after you are out on bail (if you could afford it, that is, otherwise you'd have to deal with the public defender, just don't be rude to your public defender, they are still qualified lawyers, just with higher workload)
Remember, the "only one call" rule is a hollywood thing, but if the person you are calling is not a lawyer, the calls can be legally recorded.
Depends on your jurisdiction. What's supposed to happen is any questions stop, they may let you reschedule at a later date with your attorney, or they may hold you for arraignment. Usually they will have a list of defense attorneys, or your county may have a defense attorneys hotline, or at least a yellow book. But it entirely depends on where you are.
If you are booked in a location that doesn't have any information available. I would suggest calling a friend or family member to contact an attorney for you.
You may choose to say, "I would really love to help you in your investigation, but I would like to speak to my lawyer first." I would choose to say, "Fuck off fucking fascist." ¯\_(ツ)_/¯
And you would be sitting in a cell awaiting arraignment, the exact place the police want people who do not cooperate with authority.
I never said to actually provide the police with any information. The whole point of having a lawyer is that they get to handle the heat.
With an attorney present saying that you won't cooperate isn't a crime. All you'll have to say is, sorry I would like to help but I've been advised by my legal representation to not speak to you.
The problems is that there are many people who, even when they themselves are generally powerless and under somebody's boot, positively relish the opportunity to feel superior to somebody else by helping press the boot on them.
Sadly, some of the oppressed are only meek or nice out of fear because of where they are in their power structure they'e in and when they get or are given the power to do so without consequences, turn into evil oppressors.
Since generally there are at least a few assholes around who will totally enjoy the "power" of fucking somebody else's life and often the assholes don't even behave like assholes in every day life (because they usually don't have the power to be assholes with impunity) so one might not even be aware of their low moral characters, merelly a "if you this to not get involved you won't be helping the Fascists" line of advice is not enough.
There has to be something beyond that, at the very least so that wannabe assholes fear being spotted and suffering reprisals if they do act like assholes, which if you want to make it as above the Law as possible (rather than merelly "I know which car you drive and it would be a shame if it got damaged overnight") does require some form of involving the community to create a perception that those who rat will get into trouble with the rest.
The problem is not simply solved or even significantly so with a mere "don't tell the pigs anything" (i.e. "Do No Evil"), even though those who act thus do gain the moral high ground by acting like that.
I'm sorry that I myself am not really offering a concrete solution, and my contribution is just pointing out that a Passive-Aggressive approach won't really do much more than slightly delay the Fascists and their dogs.
The violence that would be given to a lawful, rights bearing, legitimate citizen with full rights and privileges will pale in comparison to the violence that will be done to someone who doesn't have all those privileges.
If something is done to a lawful citizen, then they can have some kind of recourse to do something about it. Someone who doesn't have the same rights will have little or no choice to do anything about the violence done to them.
Once you give in to any kind of violence .... the violence only becomes worse for everyone.
You think you have rights until there's a gun in your face, that's the whole point, you get it worse if you don't capitulate because standing up to them is the biggest most unforgivable crime there is.
Make no mistake your silence WILL be met with violence.
And if they are asking you you can bet your ass you are under suspicion of dissent.
There is no safety under a totalitarian government. And guess what? Party members are at risk too! It's a brilliant system.
Not toeing the line? Purged. Toeing the line too much to make a superior look worse? Purged. Wrong joke to the wrong person? Purged. Using a slightly outdated line of propaganda? Definitely purged. Keeping your trap shut and shaking your head? Believe it or not, purged, because you didn't help them.
It's super fucked, and I'm anything but sorry for people who payed so little attention to every goddamn history class ever to not know this.
Nazi Germany saw 21,900,000 people killed by policy, and that number doesn't include civilian collateral damage from the war.
Tell them you know where to find lots of heavily armed illegals up to no good, and give them the names and addresses of any Maga friends and family members you know.
Maybe lie that their last names are Sanchez or Ramirez. Waste their time and energy. If they come back, just shrug and say you thought your racist Mom/dad/uncle/supervisor was an illegal but thanks for investigating.
Its harder than that. They have to prove you knew at that time. You can absolutely temporarily forget things.
Which is why the trump documents case was such a crazy case. We litterally have a conversation of him with a journalist saying "I have these documents, I can't declassify them now, and I know it's illegal for me to have them". Fucker should have gone to jail, it does not get more dead to rights than that.
they just raided a restaurant I think. though I'm not sure they asked people questions about neighbors I think they just violated the 4th amendment and asked for papers.
I always forget that not everybody had a Buddhist hippie uncle and aunt doing lessons with them on the weekend.
My cousins and I will randomly say, "What is (Uncle's) number one rule?"
And everyone present will chant a phrase thst would dox me, that boils down to "don't help the police!"
We can all play a part. Mutual aid means using whatever you bring to the table. If you can, think of it like a video game or a tabletop game. I look like I do and made a lifelong practice of learning how to talk to people. Now I have a high diplomacy check (and sense motive.) My boyfriend spent most of his life in the military, and his capacity for violence makes him the barbarian. Together, we are prepared to help in many, many more ways than either of us could ever do alone.
And the bigger your circle, the more situations you're prepared for! If you haven't yet, take an honest assessment of your skills. Figure out how you can most help others. You don't have to be an S rank talker or violencer, you can be bad at the skill you pick! The important thing is to pick the skill, *then work on it. *
Even if you don't have a circle, if you're all alone, you can be preparing yourself to help others who need it. You are valued. You are loved, even if you don't know it, even if it's easy to feel like you're not. And when you eventually find your tribe, or when your tribe is being attacked, having skills to help others and yourself is the best thing you can do.
But somehow also "not only white people!!11" (my morbid curiosity kinda wants to know who the fuck else you think christo-fascist white supremacy* is serving, benefitting and protecting, but my sanity demands I don't engage with you any further).
Which amasses to "I'm too busy centring myself* and my whiteness*, and finding a way to claim some victimhood in this situation, to hear what those who are actually under attack are saying"
Non-whites have never been police, never talked to police, never voted for the Evil Party and shouldn’t be included at all in advice to not be evil, misguided or duped.
so... in the age of digital surveillance, no one needs to ask other humans about each other. most humans willingly or unknowingly give all their data, like location, identity and more
you could point everybody in the direction of privacy, which might actually help disenfranchised peoples (if you ignore facial and gait recognition, voice and emotional analysis tracking throughout most cities...)
not legal advice, and not advocating anyone doing anything illegal of course
It's a bit too late for that, the digital information is already out there, and trying to hide any of it now wouldn't be much use against physical door to door/workplace/school/church raids anyway.
well for other "law abiding" peoples, we should train them. since there were rules against eating specific icecreams on certain days in the US and the nazi party in germany retroactively enforced new laws, so things can change quickly
You say that as if you think the Democratic Party is something other than White Moderate (in the MLK sense) Collaborators. They will certainly not be the ones to write such a handbook.
They aren’t here to help either. Just another flavor of wolf in sheep’s clothes to support the super wealthy that run the country. Though this one seems a little less capable of malice. I still can’t tell if that’s a sliver of morality hanging on the through a beating of self ineptitude.
Why is it okay to group white people together and not any other race? Its an economic/historic thing, not a race thing. It also varies by country and geography. Stop being racist.
Stop being racist.
Stop being racist.
