Former Grand Rapids police officer Schurr is appealing a judge's decision to send his murder charges in the killing of Patrick Lyoya to trial.
Fleeing from the police should never be a justifiable reason to fire your weapon.
The weapon is there to protect an officers life. Not as a tool of compliance
When the town I lived in got tasers, we were told they would ONLY be a last resort, to keep an officer from needing to use a pistol to stop a threat. The very next quarter, their training mostly covered how to use it to get compliance from suspects…
When I was with an ex of mine, the cops were at her house because her sister got attacked at school, as I walked down to the house one of the cops saw me, put his hand on his tazer and stared me down the whole time he was there.
This seems to be EXACTLY what the police don’t understand.
But if I’m being honest, I think the system is setup intentionally so that they blur the line.

I mean, it might be the attorney's hail mary. I think an attorney is required to put in reasonable effort or something maybe?
Theyre obligated to try to put up a defense even if there isnt a reasonable one.
The lawyer is trying to get him off on a technicality? "Well, your honor, the law does not say that the suspect has to pose a danger to the officer, just that they be fleeing arrest. My client was well within his legal rights to gun the violent thug… I mean victim, down."

Video shows Schurr wrestling with 26-year-old Lyoya before firing his weapon into the back of Lyoya's head. The video appears to show Lyoya trying to gain control of the officer's stun gun, with Schurr shouting "Let go of the Taser" before firing the fatal shot.
But also that:

Huh. Well, cops stories in these events are always fluid — probably both versions are "the official version" of what happened, or have been.
Except the first (the fact that the shot was fired during a fight) is based on video footage. The second (that the suspect was down on the ground) is.how the prosecutor explained it. I assume the ex-officer knows the first rule of what to do after you are arrested: shut up and let your lawyer speak on your behalf.

I'm sure there are plenty of beautiful cops who deserve prison time too
